1. Introduction

These Terms of Use govern your use of Enneagram Guide ( https://enneagram.guide), a platform owned and operated by Arkipelago LLC (“Arkipelago,” “Company,” “We,” “Our,” or “Us”), which includes our website, proprietary assessment tools, data, software, and other services provided by us (the “Services”).

This document, together with our Privacy Policy, constitutes a legally binding agreement (the “Agreement”) between you and Arkipelago LLC in relation to your use of our Services. If you do not agree with these Terms, do not use the site.

2. No Therapy Services or Medical Advice

The Services are provided for educational, entertainment, and self-discovery purposes only.

Arkipelago LLC does not provide therapy services, medical advice, or clinical psychological diagnoses. We do not engage in patient diagnosis or the practice of medicine. Please do not ask Enneagram Guide for, or rely on anything we communicate as, medical advice or a substitute for clinical therapy.

Although our assessments use psychometric methods and computer-assisted algorithms, we make no warranty whatsoever that the results are accurate, up-to-date, or error-free. Even if a statement we make is accurate, it may not apply to your specific psychological profile. Use of the website and/or Services does not establish a doctor-patient relationship.

3. Computer-Assisted Assessment and Accuracy

Please read this section carefully regarding our use of proprietary computer-assisted assessment algorithms.

The Services utilize a proprietary computer-assisted assessment algorithm and machine learning technologies to analyze your test responses and categorize them against the Enneagram personality system. By using the Services, you acknowledge and agree to the following:

Probabilistic Nature

While we strive for high accuracy in our psychometric modeling, the assessment algorithm may generate incorrect, stereotyping, or biased outputs. You should evaluate the accuracy of any output as appropriate for your use case, including by using human review.

No Guarantee

We do not guarantee that the assessment algorithm will perfectly reflect your personality. The Enneagram is a theoretical framework, and computer-assisted assessment of this framework are subject to limitations.

Proprietary Rights

The assessment algorithms used to generate your results are the exclusive intellectual property of Arkipelago LLC. You agree not to use the output to reverse engineer, train, or improve any other artificial intelligence or machine learning models.

4. Acceptance of Terms of Use

BY ACCESSING, VISITING, BROWSING, USING, OR ATTEMPTING TO INTERACT WITH OR USE ANY PART OF THE SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS OF USE AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OF USE OR THE PRIVACY POLICY, DO NOT ACCESS OR USE ANY PART OF THE SERVICES.

5. Eligibility

The Services are intended only for access and use by individuals at least eighteen (18) years old. By accessing or using any of the Platform, you warrant and represent that you are at least eighteen (18) years old and have the full authority, right, and capacity to enter into this Agreement.

6. Description of the Services

Enneagram Guide provides free and paid personality assessments, utilizing proprietary assessment algorithms to categorize users within the Enneagram personality system. We may release new tools, reports, and features, all of which will be subject to these Terms of Use.

7. Your Account

When you create an account with Enneagram Guide, you are responsible for maintaining the confidentiality of your login information. You are responsible for all activity emanating from your account. We reserve the right to suspend or terminate your account if activities occur that violate these Terms of Use.

8. Payment and Refund Policy

Payment

You may pay for premium assessments via the payment methods provided at checkout (e.g., Credit Card, PayPal). Your card will be charged upon receipt of your order.

Refunds

Refunds are granted at the sole discretion of Arkipelago LLC. Generally, because the Service is digital and immediately consumable, we do not offer refunds on completed assessments unless there is a technical failure preventing the delivery of the report. If you believe there has been a major failure in the provision of Services, please contact support.

9. Changes to Services and Pricing

Arkipelago LLC reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time. We may also change pricing for our paid assessments. Any price changes will apply to subsequent purchases and will not affect orders already placed.

10. Your Use of the Services (License and Restrictions)

Subject to your compliance with these Terms, Arkipelago LLC grants you a limited, personal, non-exclusive, revocable, non-transferable right to use the Services to generate and view your personality report.

You agree strictly NOT to:

Reverse Engineer

Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of the assessment tool.

Scrape

Use scraping, spiders, or similar data gathering tools to aggregate content or replicate the assessment logic.

Commercial Use

Sell, license, or exploit the Services or the generated reports for any commercial purpose without prior written consent from Arkipelago LLC.

Harmful Content

Input content that is illegal, offensive, or intended to disrupt the Service (e.g., prompt injection attacks against the AI).

11. Intellectual Property Rights

The Services, including the website design, text, graphics, and specifically the proprietary assessment algorithm, are owned by Arkipelago LLC or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Enneagram Guide and all related logos are trademarks of Arkipelago LLC. You must not use such marks without prior written permission.

12. Content Disclaimer

The Services may generate content based on user inputs. While we strive for accuracy, Arkipelago LLC cannot guarantee the completeness or timeliness of any content. You rely on the assessment results at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARKIPELAGO LLC BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, THE ASSESSMENT ALGORITHMS, OR THE PERSONALITY REPORTS.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, OR OTHERWISE). WE SPECIFICALLY DISCLAIM LIABILITY FOR ANY DECISIONS YOU MAKE BASED ON THE GENERATED ANALYSIS PROVIDED BY THE SERVICES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Arkipelago LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services or your violation of these Terms.

15. Applicable Law and Dispute Resolution

Governing Law

These Terms shall be governed by the laws of the State of Oregon, without regard to its conflict of law provisions.

Binding Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively by final and binding arbitration administered by JAMS or a similar arbitration body selected by Arkipelago LLC, conducted in Oregon. You waive your right to a jury trial and to participate in a class action lawsuit.
